USER’S ACCEPTANCE
Welcome to Klomsy! By using our website, you agree to follow the terms and conditions outlined below. If you don’t agree with any of these terms, please refrain from using our services. We may update these terms from time to time, so it’s a good idea to check them periodically. Your use of Klomsy constitutes your acceptance of these terms.
YOUR KLOMSY ACCOUNT
To enjoy all the features Klomsy has to offer, you need to create an account. Keep your account details secure, and don’t share them with others without permission. If you notice any unauthorized use of your account, let us know right away. Remember, you’re responsible for all activities that occur under your account.
ORDERING/PRINT ON DEMAND SERVICE
Order Changes/Cancellation: You can modify or cancel your order before we start processing it, changes or cancellations afterwards may not be possible. Please contact us, and we’ll do our best to assist you. If your order is already in processing, refunds may not be guaranteed.
RETURNS & EXCHANGES
We want you to be happy with your purchase. If there’s an issue with the product, like a manufacturing defect, contact us with photos or videos showing the problem. We’ll review your request for a replacement or return. Please note, size exchanges or general returns are not typically accepted unless there’s a defect.
REFUNDS
Refunds will be considered based on the type and extent of the defect. We reserve the right to decide whether a partial or full refund is appropriate.
PROCESSING / DELIVERY TIMELINE
We aim to process and deliver your orders promptly, but specific timelines can’t be guaranteed.
FULFILLMENT DELIVERIES
While we provide tracking information, we’re not responsible for third-party delivery delays, lost packages, or damage during delivery. Please track your package and contact the delivery service for assistance.
PAYMENTS OF GOODS
All orders must be paid in advance. To pay for orders, make a deposit equal to the order amount.
FILE STORAGE
We don’t guarantee permanent storage of your design files. If you’re inactive for an extended period, we may delete your files. Inactivity could mean no sales in a certain period or no logins for a specified time.
USER’S SUBMISSIONS AND OWNERSHIP
When you submit content to Klomsy, you should own the necessary rights or have permission to use and authorize us to use that content. You retain ownership, but by submitting, you grant us a license to use it. Make sure your submissions don’t infringe on others’ rights.
WARRANTY DISCLAIMER
We do our best, but we can’t guarantee perfection. We’re not liable for errors, interruptions, or any issues arising from using our website. Exercise caution and use your judgment when making purchases.
LIMITATION OF LIABILITY
We’re not liable for direct or indirect damages resulting from various factors. Be aware that we’re not responsible for third-party conduct or any harm caused by user submissions.
INDEMNITY
You agree to defend, indemnify, and hold us harmless from any claims arising from your use of our website or violation of these terms.
ABILITY TO ACCEPT TERMS OF SERVICE
By using Klomsy, you confirm you’re over 18 or an emancipated minor with the legal capacity to agree to these terms. If you’re under 13, please don’t use Klomsy.
ASSIGNMENT
You can’t transfer your account, but we can assign our rights.
GENERAL
These terms are governed by Indian laws. Any disputes will be decided in India. These terms, along with our policies, constitute the entire agreement between you and Klomsy. If any provision is deemed unenforceable, it won’t affect the rest of the terms.
GENERAL TERMS
We use Direct to garment Digital printing method for all our cotton apparel styles. It has some specific fabric and design file requirements. Minimum charges for printing applicable for smaller print sizes. We ensure to get optimum screen printing like output for all our printed apparels, but in very few cases there may be small whites seen which is not totally avoidable. All clothing products are subject to measurement variation upto half inch. As all the apparel styles are stitched by humans this is unavoidable, but with strict quality guidelines and systems we keep this to very minimum. Our prints on cotton apparels are to withstand around 30 washes when washing instructions are followed which are Cold Wash, Tumble Dry, Dry in shade, Do not wring and Do not bleach. All 100% cotton garments are shrinkable upto 3-4% as international quality standard. We maintain all our apparel styles well within this limit.
DISPATCH & DELIVERY
Klomsy works on to dispatch all the orders placed within 2-3 working days. The day in which order is placed is counted when it’s placed before 12 noon. We made a very efficient production line over time to handle the process effectively in case of sudden surge of orders.
We transfer an order to “NO DATA” status when there is no sufficient data to process an order. You will get email and sms for the same. You should act on that immediately for timely processing of orders.
Any claim on dispatched items has to be made within 30 days of the delivered date. No claims whatsoever will not be accepted beyond this time.
We work with third party courier companies like FedEx, Delhivery, Bluedart, ECom Express and Software Solutions like Shiprocket etc for our logistics operations. For any delay/error in shipment delivery, we have an automatic escalation system which can be escalated by you from your email. You can contact our support team as well and we will escalate it for you to get it delivered. But there may be reasons like partner errors, customers refusing the shipment, not picking a call, expecting delayed delivery repeatedly for return to origin (RTO) of shipments. Klomsy cannot be held responsible for this. However, we assure we will take our best efforts to get all orders delivered.
International shipment to certain countries may attract extra customs duty from customers, which has to be borne by your customers. Klomsy offers prepaid courier services to all pin codes in India. Charges for remote areas which can be served only through India Post will be higher and will be deducted accordingly. Courier delays in certain areas may happen in uncontrollable ways due to natural calamities, city lockdown, bandh, local festival etc.
PAYMENTS
Klomsy accepts payments in online mode where you pay using credit/debit card or UPI
If a customer pays in Cash on delivery for a prepaid order by mistake, we do not get that amount from courier companies and hence cannot pay you for the same.
RETURN SHIPMENTS
Klomsy stores all return (RTO) shipments for 100 days as individual products by opening and labeling each one. Orders returned manually by the customers cannot be stored and re-shipped individually.
No product or order of yours will be discarded for any reason. Handling and re-shipping
cost of return(RTO) shipments are not included in the cart value shown for shipping while customer places an order. Hence shipping fee for returns will be deducted while refunding for such cases. If there is an exchange of items in the order for return orders, shipping fee for that will be charged as per the above point.
